Terms of Service

1. Acceptance of Terms

By accessing or using Orbit ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

Orbit is operated by Foundry Apps, a business based in Guernsey, Channel Islands ("we", "us", "our").

2. Description of Service

Orbit is a web application that aggregates and displays space mission data, including launch schedules, ISS real-time tracking, astronaut information, and space events. The Service offers a free tier and a paid "Pro" subscription with additional features.

Space data is sourced from third-party public APIs (Launch Library 2, NASA, SpaceX) and is cached in our systems. We do not operate any spacecraft, represent any space agency, or have any affiliation with NASA, SpaceX, ESA, or The Space Devs.

3. User Accounts

  • You must be at least 13 years of age (or the minimum age in your jurisdiction) to create an account.
  • You are responsible for maintaining the security of your account and for all activity that occurs under your account.
  • You must provide accurate information when registering. Accounts are created via Google OAuth — you are responsible for the security of your Google account.
  • You must notify us immediately of any unauthorised use of your account at david@foundryapps.co.uk.
  • One account per person. You may not share accounts or create accounts on behalf of others without their consent.

4. Free Tier and Pro Tier

Orbit is available on two tiers:

  • Free Tier: Provides limited access to upcoming launches (next 5), ISS tracking, and upcoming events (next 3) at no cost. No payment information is required.
  • Pro Tier: Provides access to all launches (upcoming and historical), full mission details (crew, payload, orbit parameters), the astronaut directory, all events, and advanced features. Pro requires a paid subscription.

We reserve the right to adjust what is included in each tier with reasonable notice to existing subscribers.

5. Subscriptions and Billing

  • Merchant of Record: All Pro subscription payments are processed by Paddle (Paddle.com Market Limited), who acts as the Merchant of Record for all transactions. This means Paddle is responsible for collecting payment, remitting applicable taxes, issuing receipts, and processing refunds. Your purchase contract for billing purposes is with Paddle, not Foundry Apps.
  • Recurring billing: Subscriptions renew automatically at the end of each billing period (monthly or annual) unless cancelled. You may cancel at any time; access to Pro features continues until the end of the current paid period.
  • Pricing changes:We reserve the right to change pricing with at least 30 days' written notice to existing subscribers. Continued use after price changes take effect constitutes acceptance of the new pricing.
  • Payment data: We do not store your payment card details. All payment information is held by Paddle.
  • Refunds: Our refund policy is set out at orbitlaunches.space/refund-policy. Refunds are processed by Paddle as Merchant of Record.

6. Data Accuracy

Space mission data is sourced from third-party APIs (Launch Library 2, NASA, SpaceX) and is provided "as is". We make reasonable efforts to keep data current, syncing approximately every 15 minutes, but we do not guarantee the accuracy, completeness, or timeliness of any information displayed. Launch schedules are subject to change by the respective launch providers and space agencies, and Orbit is not responsible for decisions made based on data displayed in the Service.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to the Service or its systems
  • Scrape, crawl, or otherwise extract data from the Service in bulk
  • Interfere with or disrupt the Service or its infrastructure
  • Share your account credentials with other people
  • Use the Service in any way that infringes the rights of others
  • Circumvent or attempt to circumvent Pro feature gates

Violation of this section may result in immediate suspension or termination of your account without refund.

8. Intellectual Property

  • Orbit (our IP): The Orbit name, logo, original design elements, application code, and user interface are the intellectual property of Foundry Apps.
  • NASA data: Space mission data from NASA APIs is in the public domain under the Creative Commons CC0 1.0 licence. We make no proprietary claims over this data.
  • SpaceX API data: Data from the SpaceX API is provided under the Apache License 2.0.
  • Launch Library 2 data:Data from The Space Devs' Launch Library 2 API is provided under a Creative Commons licence and attribution is given in our footer.

9. Limitation of Liability

Nothing in these Terms limits or excludes any liability that cannot be excluded or limited by applicable law.

Subject to the above, and to the fullest extent permitted by law: the Service is provided "as is" without warranties of any kind, express or implied. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data, arising out of your use of the Service. Our total liability to you for direct losses shall not exceed the greater of: (a) the total amount you paid to us in the 12 months preceding the claim, or (b) £100.

10. Termination and Suspension

  • We may suspend or terminate your account at any time for violation of these Terms, with notice where reasonably practicable.
  • You may close your account at any time. See our Refund Policy for the applicable refund terms on cancellation.
  • Upon termination, your right to access the Service ceases immediately. We will handle your data in accordance with our Privacy Policy.

11. Changes to Terms

We may modify these Terms at any time. For material changes, we will give at least 14 days' notice to registered users via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not accept the updated Terms, you must stop using the Service and may close your account.

12. Governing Law and Disputes

These Terms are governed by the laws of the Bailiwick of Guernsey. Any disputes arising from these Terms or your use of the Service shall be subject to the non-exclusive jurisdiction of the Royal Court of Guernsey. Nothing in this clause affects your rights under the consumer protection laws of your country of residence.
